Azat Nigmatzyanov explained the changes in federal laws relating to the construction sector.

In 2018, global changes occurred in the field of land, urban planning and civil law, said Azat Nigmatzyanov, the first deputy head of the Executive Committee, today at the Business Monday. He told what impact innovations had on the work of developers and municipal bodies.
In particular, A. Nigmatzyanov expressed concern about the amendments made to the 214-FZ “On participation in shared construction”. “The amendments to this law almost eliminate share construction. Therefore, developers of residential buildings can no longer use the shareholders’ money. Attracting funds from citizens for the construction of housing is now possible only through special accounts at authorized banks”, said A. Nigmatzyanov. He marked that this sector of the economy, which generates about a quarter of the gross product and employs more than 40 thousand builders, may be in the zone risk. According to the speaker, it is possible to avoid risks if the proposal of Rustam Minnikhanov, the President of the RT, is adopted at the federal level to complete the construction of these facilities according to the old rules.
Companies engaged in housing, have already responded to the innovations. If from the beginning of 2018 to July 1, 82 permits were issued for the construction of residential houses, then from July 1 to the end of the year, there were only 2 permits.
There were innovations in the construction of individual houses and garden houses. Since the beginning of August last year, for constructing individual houses, you only have to submit a notice of the planned construction. Now the law requires the Board to consider notifications about the planned construction of individual housing construction and garden houses within 7 working days. In addition, in order to reduce the time for issuing commissioning permits, the process of approval of permits was transferred to the electronic document management system in 2018.
Separately, A. Nigmatzyanov mentioned changes in the sphere of regulation of linear objects with the adoption of Law №341-FZ. This law is of particular importance for Kazan, since a large number of linear objects are planned to be built in the city, marked the first deputy head of the Executive Committee. In the capital of Tatarstan, it is planned to continue the construction of the Big Kazan Ring, the construction of a backup road for the Gorkovskoe Highway, the second line of the Kazan metro, the high-speed Moscow-Kazan highway, as well as various power supply networks, gas distribution, and others.
“The law establishes a new regulation on the use of land for the construction of linear facilities by creating a public servitude. Today, the approximate period of work on the withdrawal of land is 1-2 years. According to the new law, the establishment of a public servitude should take from 30 to 70 days. This will allow starting construction of linear objects faster”, explained the speaker.
The changes also affected the procedure for establishing zones with special conditions for the use of the territory. For example, the establishment of sanitary protection zones will be made based on actual measurements. For this, the developer carries out full-scale measurements during the year after delivering the object, the results of which can both reduce and increase the sanitary protection zones.
In addition, significant work was carried out on the design of permission documents. According to the speaker, last year in Kazan, 381 building permits were issued and 224 commissioning permits.
“The development of the construction sector is complicated by changes in legislation”, noted Denis Kalinkin, the head of the Executive Committee. “However, despite this, the plans and tasks set by the Government of the Republic for 2018 have been fully implemented”.
