The development and support of the self-employed was the main topic at the XI meeting of the Council for Entrepreneurship under the President of the RT.
(KZN.RU, March 11, Alena Miroshnichenko). The XI extended meeting of the Council for Entrepreneurship under the President of the RT Rustam Minnikhanov was held today in the KRK “Pyramida”. The main topics of the current discussion were the development and support of self-employed republican entrepreneurs, the stimulation of entrepreneurial initiative and the creation of quality conditions for the development of self-employed. Boris Titov, the commissioner under the President of the RF for the Protection of the Rights of Entrepreneurs, deputies of the State Duma of the RF Gennady Onishchenko and Airat Farrakhov, Milena Arslanova, the director of the Investment Policy Department of the Ministry of Economic Development of the RF, and others attended the meeting. More than 200 businessmen participated in the meeting.
Speaking with an opening speech, Rustam Minnikhanov noted that the issue of self-employed is very topical today. He reminded that Tatarstan was among the four pilot regions where the experimental tax regime for the self-employed is in effect fr om January 1, 2019. Thus, on March 4 of this year, more than 4 thousand self-employed citizens registered in the republic.
“My personal opinion is that the decision on the self-employed is very correct and well-developed. But, nevertheless, when we began to implement all these approaches, we saw that many more questions need to be improved. Including improvements at the federal level. I believe that we need such steps in our country that will allow people to quietly enter the legal business. Today, we need certain actions in order for all this to happen”, said Rustam Minnikhanov.
Boris Titov, the commissioner for the Protection of the Rights of Entrepreneurs under the President of the RF, stated that within the framework of the experiment conducted in four regions, Kazan is the center of many entrepreneurial qualifications that work in different directions. “Here in Kazan, we can see the pulse of this small and medium business, and therefore it is important for us that one of the most progressive, technologically complex experiments succeed. Indeed, we are putting the relationship between business and government in the digital domain today. And according to how the experiment goes, what advantages and disadvantages it has, it is very important to get feedback in time and correct the legislation accordingly”, he said.
According to Boris Titov, this is a serious technological digital experiment. It brings to the legal sphere those businesses that were invisible before. “But of course, the experiment is difficult. It performs the function at a lesser extent we were expecting: this is the mass legalization of millions of entrepreneurs who are working today, but stay in the shadows”, marked B. Titov.
Today, the discussion between representatives of the government and the business community brought up the following issues: sanitary standards for self-employed confectioners, reducing the risks of self-employed entrepreneurs working with banks, registering foreign citizens as self-employed, participating of self-employed in government procurement, the cooperation of self-employed with legal entities, etc.
Ildar Nizameev, the head of the GC ILAR, spoke about his successful experience of working with self-employed people in the creative industry. “This makes it possible to legally attract the best personnel fr om all over Russia”, he noted. However, he shared his fears that one day, the relevant body could charge its tax, finding this type of work similar to labor relations. R. Minnikhanov, in response to the appeal, addressed colleagues from the State Duma of the RF with a request to clearly distinguish between these concepts. “We need to resolve the issue with the interpretation. If we entered the experiment, we should get the appropriate explanations. Today, the system of working with self-employed is transparent. This is unprecedented, there is no such thing in the world. Everything is under control: volumes, each payment. Today it is wrong to impose restrictions”, he believes.
Airat Galeev, the director of Digital Security, a company engaged in a vehicle monitoring system, raised the issue of working with remittances by the self-employed. “In my opinion, the state has made a good step towards individuals. But on the part of the entrepreneur, any transfers are the transfers to individuals. And for large transfers, banks begin to check the organization for possible money laundering, all documentation is requested. This is a big burden for organization accounting. Banks do not always approve and generally can close the account”, said the entrepreneur. In his opinion, the law is an excellent tool for legalizing relationships, but banks can prevent the wide spread of this practice. His proposal is to allow self-employed to open current accounts. This will help to distinguish between transfers to individuals and transfers for goods and services to self-employed people and will encourage businesses to move more actively to work with freelancers clear, requiring them to register as self-employed.
A. Farrakhov noted that such a problem is present indeed. “When they have worked out the law, they proceeded from the needs of entrepreneurs and the self-employed. It regulates the legal regime, but really does not regulate relations with the Bank of Russia. Each bank must follow the methodological recommendations of the Central Bank”, explained the deputy of the State Duma of the RF. However, he advised the President of the Republic and entrepreneurs to prepare an order to the State Duma, which could initiate changes to the instructions of the Bank of Russia.
The restaurant “Sultanat” also wants to actively cooperate with the self-employed, but does not have such an opportunity due to its specificity, said Irina Danilova, the head of the institution. A distinctive feature of the restaurant is its oriental flavor. Citizens of Azerbaijan, Uzbekistan and other Asian countries are hired as employees. The problem is that it is impossible to invite foreign citizens for project work and for major events. They do not have the right to be self-employed, she said.
A. Farrakhov said that in accordance with the law on the tax on professional income, only citizens of the RF or member countries of the Eurasian Commonwealth can register as self-employed.
“We need foreign citizens to have the status of self-employed, but here we have to consider the lim it of their activities”, said R. Minnikhanov. “If we fail this project, then the shadow economy, with which we fight, as it was, will remain so. Let's try to make all these mechanisms work”.
A very topical issue at the meeting was the work of home confectioners. One of them, Zulfiya Faizrakhmanova, was registered as self-employed so that her activities were legal. “There are no complaints on the tax. But certification is not provided for home confectioners, which could secure both the client and me. However, SanPiN norms were originally invented as workshops”, she said. The second difficulty in her work is a declaration, which, according to the existing norms, is very heavy for home specialists. Z. Faizrakhmanova sees the solution to the problem in the development of technical and sanitary standards specifically for the work of home confectioners. R. Minnikhanov supported the initiative and reminded those present of a similar precedent, when a special system was developed for small bread bakeries.
“Our entire economy is sharpened for industrial production. We need to make simplified safety and quality requirements today. If you don’t protect yourself with minimum standards, big business will bully you”, G. Onishchenko addressed the home confectioner. He encouraged his colleagues to create a working group wh ere entrepreneurs and self-employed will become the initiators of the system’s development, and deputies and government representatives will become experts. “We need to create an association to monitor the regulatory framework, training, and other support”, he added.
“I believe that the support of the self-employed is very important. If we do not adjust the mechanisms at this stage, then, of course, this may be ineffective. I am sure that this message, an attempt to get out of the shadows is very effective. We try to create the conditions for people to come out of the shadows. We must send those questions that have been voiced to the appropriate authorities. Each requires elaboration, clarification, and documents. I am convinced that everything that we discussed today will give a good positive result”, R. Minnikhanov summarized the meeting. He added that there are new challenges ahead, therefore such meetings will continue in the future.
